Instructional goals
The course aims to provide students with the theoretical and practical tools to independently handle the most recurrent activities and problems in the various professional fields related to obtaining a law degree (corporate lawyer, freelancer, magistrate, notary public, civil servant, etc.).
With this in mind, each lecture in the course is structured in two parts:
(i) A first part, during which students are shown the approach and techniques of drafting the various types of legal acts (opinion, judicial deed, contract, resolution of shareholders' meeting and board of directors, etc.) and the students themselves are stimulated to try their hand at the preparation of such acts, through assignment of exercises to be carried out asynchronously at home; and
(ii) a second part, during which the students, in order to have additional data and information to evaluate the professional path to be taken once the University cycle has been completed, will be able to meet with speakers of the highest level, including lawyers of the free bar, representatives of independent Authorities and General Counsel of leading Italian and multinational companies, who, in addition to recounting their professional experience, will deal with a topic inherent to the subjects studied within the scope of the profile.
Prerequisites
Knowledge and understanding: The student, through participation in the lectures and interactive teaching activities with the lecturer, and guest lectures, upon completion of the course, will have acquired greater skills in drafting judicial and extrajudicial documents and a more thorough overview of possible career paths to take, with this the tools for a more informed choice.
Ability to apply knowledge and understanding: The student will be able to frame and solve legal problems related to concrete cases examined in class and will know the structures of the main judicial and extrajudicial acts.
Autonomy of judgment: The student, through the knowledge, skills and tools acquired in class, will develop greater autonomy in evaluating and judging the topics of the course and will be able to correctly set up activities prompted by the problems of practice. The development of critical thinking will be encouraged, including through the production of work in asynchronous mode at home.
Communication Skills: The student will learn to use legal language correctly in the performance of the assigned exercises on which a discussion with the lecturer will develop at the time of their correction.
Learning skills: The student will be able to apply the skills acquired to problems other than those covered in class.
Intended learning outcomes
General knowledge of law, both substantive and procedural.
Course Contents
The course is divided into distinct parts depending on the type of legal act the student is asked to grapple with and the experience of the speakers who are hosted in class, who will give different insights with respect to the realities to which they belong.
With regard to the latter aspect, the speakers will bring their professional experience, cover topics related to the subjects covered by the Law & Innovation profile and thus stimulate students to make a more informed decision on the possible career path to take.
More specifically:
- in the first part, consisting of the first four lectures, lawyers from the free bar and experts in the disciplines will be guests;
- in the second part, consisting of three lectures, the heads of the three independent authorities will be guests: Privacy Authority, AGCM, AGCOM;
- in the third part, consisting of the last four lectures, general counsel and top management of leading companies in the Italian and multinational scene will be guests.
Reference Books
The teaching material consists of the content of the lectures given by the lecturer and the material, slides and handouts, which will be provided by the speakers before the respective lectures, shared on Luiss Learn.
Teaching Methods
Learning: face-to-face and interactive lectures.
Practice: drafting technique tools, legal acts, expert guests and practical simulations.
Investigation: analysis of different ideas and solutions.
Collaboration: small group work, discussion of others' results and proposal of common results.
Discussion: in-class group discussions, synchronous and asynchronous discussions.
Production: students will also asynchronously carry out exercises related to the drafting of acts and measures explained in class. Among these acts and measures, each student will have to carry out a minimum number of six exercises at his or her discretion.
Assessment Method
The examination will involve the preparation of judicial and extrajudicial acts or measures on the topics covered in the lectures (40%)
Active participation in the discussion and confrontation activities carried out in class will also be evaluated (20%)
The result of the final exam, consisting of the independent formulation of a deed or opinion, will also be evaluated (40%)
The exam will be considered passed with the attainment of a minimum of 80% of the maximum score available.
Thesis assignment criteria
Interest in the topics covered and effective participation in the planned training activities.
Week 1
INTRODUCTORY LECTURE TO THE COURSE.
Presentation of the overall structure of the course, description of the three categories of speakers we will be hosting, indication of teaching methods and how learning will be verified.
Week 2
CYBERCRIME / THE LIABILITY OF THE SERVICE PROVIDER.
The meeting will be held by an expert in the discipline who will deal with the subject matter of the meeting under the criminal law angle and will delve into the methods for drafting opinions on this issue, developing opportunities for comparison and discussion among the students.
Asynchronously, students will be presented with the opportunity to write an opinion that will be part of the assessment for the purpose of passing the eligibility.
Week 3
LABOR AND NEW TECHNOLOGY.
The meeting will be held by an expert in the discipline who will deal with the subject matter of the meeting under the labor angle, presenting students with a concrete case to solve. Also, the structure of a labor extrajudicial act will be explained to the students.
Asynchronously, students will be presented with the opportunity to draft a labor extrajudicial act, which will be part of the assessment for the purpose of passing the eligibility.
Week 4
INTELLECTUAL PROPERTY
The meeting will be held by an expert in the discipline who will deal with the subject matter of the meeting from the civil law angle, presenting students with a concrete case to solve. Also, the structure of a civil court document will be explained to the students.
Asynchronously, students will be presented with the possibility of drafting a civil court document, which will be part of the assessment for the purpose of passing eligibility.
Week 5
THE DATA PROTECTION SUPERVISOR
The meeting will be held by a top official of the independent authority who will cover the topic of personal data protection and submit to the students a measure of the Guarantor on which to stimulate a discussion.
Asynchronously, students will be presented with an opportunity to draft a measure of the Guarantor, which will be part of the assessment for the purpose of passing eligibility.
Week 6
THE COMPETITION AND MARKET AUTHORITY
The meeting will be held by a top official of the independent Authority who will cover the topic of competition and the market and submit to the students a measure of the Authority on which to stimulate a discussion.
Asynchronously, students will be presented with the opportunity to draft a measure of the Authority that will be part of the assessment for the purpose of passing the eligibility.
Week 7
THE COMMUNICATIONS GUARANTEE AUTHORITY
The meeting will be held by a top official of the independent Authority who will discuss the topic of guarantees in communications and submit to the students a measure of the Authority on which to stimulate a discussion.
Asynchronously, the students will be presented with an opportunity to draft a measure of the Authority that will be part of the assessment for the purpose of passing eligibility.
Week 8
THE NEW CONTRACTS IN THE ENERGY SECTOR
The meeting will be held by the general counsel of a multinational company operating in the energy sector who will cover the subject matter of the meeting, explaining to students the new types. Also, the structure of a contract will be explained to students.
Asynchronously, students will be presented with the option of drafting a contract, which will be part of the assessment for the purpose of passing the eligibility.
Week 9
TECHNOLOGY AND MOBILITY
The meeting will be held by the general counsel of a leading company operating in the mobility sector who will cover the subject matter of the meeting, explaining to students how new technologies are being applied in this sector.
Week 10
TECHNOLOGY AND LAW
The meeting will be held by the general counsel of a multinational company operating in the service sector who will cover the subject matter of the meeting, in particular, from the perspective of extraordinary transactions. Also, students will be explained how a due diligence activity is carried out.
Asynchronously, students will be presented with the opportunity to write a due diligence checklist that will be part of the assessment for the purpose of passing the eligibility.
Week 11
SUSTAINABILITY AND LAW
The meeting will be given by the Deputy Director of a leading broadcasting company who will cover the subject matter of the meeting by explaining to students the challenges companies face in becoming increasingly sustainable.
Week 12
PRIVACY AND LAW
The meeting will be held by the general counsel and DPO of a leading company in the mobility industry who will discuss the subject matter of the meeting, in particular, from the point of view of the possible risks that companies today face regarding personal data theft and consequences.
