Instructional goals

Deepening the institutional system of the European Union legal order and the functioning of the main freedoms in the establishment of the internal market

Intended learning outcomes

1) knowledge and understanding: the student will have acquired basic knowledge of the EU institutional system and the principles governing the functioning of the internal market. 2) Ability to apply knowledge and understanding: the student will be able to understand and apply the basic rules of the Union's institutional system and the principles governing the functioning of the internal market. These objectives will be achieved through the evaluation of the relevant case law carried out in class 3) Autonomy of judgment: the student will acquire a critical awareness of the legal system of the Union, along with the formulation of autonomous judgements and the correct use of legal language 4) Communication skills: the student will acquire the ability to present the legal framework governing the EU through a good expressive technique. 5) Learning ability: the student will be able to conduct his/her own assessment of legal issues related to EU law, putting into practice the learning acquired during the lessons and the examination of practical cases

Course Contents

European Integration Process. The EU competences. The Institutional Framework. Sources of EU Law and procedures. The system of jurisdictional guarantees. Freedom of movement of goods and persons. The Economic and Monetary Union.

Lectures and examination of the relevant case law

Assessment Method

There will be two intermediate tests, which will be in written form, during the fourth and ninth weeks. If passed, these allow the examination to be divided into two parts. Both for those who have taken both tests (and must therefore only take the examination on the remaining part) and for those who have not taken them, the final examination will take place entirely in oral form.

Thesis assignment criteria

A good grade in the final exam is required and the knowledge of two foreign languages. The subject of the dissertation is agreed with the student.

Week 1

The evolution of the European Union system. The non-existence of a federal character of the European Union.

Week 2

Analysis of Articles 48-49-50 TEU. The founding values of the European Union.

Week 3

European citizenship and the competence system.

Week 4

The implicit powers. The principles of subsidiarity and proportionality Written test.

Week 5

The European institutional system. European Council, Council, Commission, European Parliament, the smaller bodies.

Week 6

The European Central Bank and economic and monetary policy.

Week 7

The European Union's system of legal sources.

Week 8

The European Court of Justice.

Week 9

Written test. The relationship between the European Union and domestic law.

Week 10

The functioning of the internal market: the free movement of goods.

Week 11

The free movement of persons.

Week 12

Analysis of case law relevant to the functioning of the internal market. Conclusion of the course.
